Judge throws out red light camera tickets

A Chicago judge is dismissing 70 percent of red light camera tickets.

“It took a lot of gumption for the judge to stand up to the city and tell them what's right,” said Barnet Fagel of RedLightDoctor.com.

Fagel, who calls himself the Red Light Doctor, said it was a big breakthrough Monday when Administrative Law Judge Robert Sussman told city attorneys that he's been throwing out 70 percent of the red light camera cases before him, and the city should get its act together.

“He got pretty irritated at the city who keep issuing these tickets when the c ameras or the traffic signals are not properly engineered or not set up right,” Fagel said.

Fagel, using his own technology, convinced the judge to throw out two tickets. In one of the cases, Fagel analyzed video of a red light violation at Diversey and Ashland. He showed the yellow light lasted only 2.629 seconds, which is less than the minimum of three seconds required by law.

Red light opponent Mark Wallace said red light camera victims have been making this argument for years, without much success.

“We believe that these red light cameras are unconstitutional, unsafe and they're unfair. The only answer to that is these red light cameras and speed cameras that have been expanding, should go,” Wallace said.

Fagel added he hasn't reached a conclusion yet about the accuracy of the city's 150 new speed cameras, but he is, in his words, “suspicious.”

Many people, including some lawyers, said they are pleased with the outcome.

A lawyer who won the ruling for two people that had received red light camera tickets said the ruling "validated everything we've been saying about short amber times for the last five years."
