Two men in a runoff election for District Attorney in the 25th district are complaining that their opponents made disparaging comments against them.

Incumbent James (Jay) Gaither is running against David Learner.

Gaither emailed a complaint to the board of elections office over a comment Lerner made in an op-ed in the local paper. Read Gaither's comments here.

Learner responded to the complaint saying his statement was an honest mistake. He said Gaither has also made disparaging comments in the race. Read Learner's response here.

Joshua Lawson with the North Carolina Board of Elections office says there’s no guarantee that this will be resolved before the runoff election.

The board of elections can only do investigations. It cannot file charges. That means if the complaint were to hold merit, the investigation would be referred to the DA’s office.

According to Lawson, in an election year like this, the state board of elections receives about 80-100 complaints.

In the republican primary in May, Gaither got 31.09% of the vote. Lerner got 39.39%. The runoff will be held in July.

The 25th district DA’s office represents Catawba, Burke, and Caldwell counties.
