Mother battling breast cancer released from jail for using false ID to get work

An undocumented valley mother, who had been battling breast cancer behind bars is out of jail.

She was arrested for using false identification to get a job, but her attorney struck a deal with prosecutors and she was released Thursday morning.

Ruth Alvarez spent a little over two weeks in jail.  She would have likely been there much longer if her family and attorney didn't fight for her release.

After 17 days and a week shy of her surgery, Alvarez walked out of the jail and into the arms of her children.

"It was horrible because I never seen myself in my life being jailed.  It was horrible," she said.

Alvarez, who has Stage 3 breast cancer, was arrested April 1 for using a false ID to obtain employment.

"I just apologize for the mistake I did and I just pray for God that he can touch his heart and let me go out and keep going with my life and do whatever I have to do," she said.

In Arizona, her crime is a non-bondable offense, so her family and attorney had to fight to get her released.

"I am still not really processing everything. I am relieved, I am really happy and excited that my mom is finally out," said Indira Alvarado.

Alvarez's attorney made a personal plea to the county attorney and the two struck a deal.

"In this particular case, because of the concerns here, Mr. Montgomery offered to allow her to plead guilty to a misdemeanor offense. Time served and unsupervised probation for one year.  So the interests of justice were protected and also the interest of Ruth's health," said Jose Penalosa.

The mother of two is scheduled to have a mastectomy next week.

"Thank you to Mr. Montgomery because without him, we couldn't do this. This has never been possible. Thank God because it really touched their hearts," said Alvarez.

There is still the possibility of deportation and she will have to appear at an immigration hearing in the future.

Many of you have been asking us through social media who is paying for her surgery.  Her attorney tells us it's a combination of private donations and her husband's insurance.
