Hammer Attack Trial: Closing arguments scheduled for Thursday

Jurors will soon be deciding the fate a Gilbert mom accused of killing her husband with a hammer.

Closing arguments in the Marissa Devault trial are set for Thursday morning.

The trial has lasted more than a month. Jurors have been listening to testimony since February 6th.

Among the prosecutions final rebuttal witnesses were the victim's friends and former co-workers

Prosecutors are trying to discredit the defense's claim that Marissa Devault killed her husband in self-defense.

The first two witnesses today were the victim's former employers.

"Did you every witness or observe him being violent or aggressive in way?" asked prosecutor Eric Basta

"Never," replied Harriet Trieskey.

"At any point during the course of his employment, did any employees or clients complain about Dale being violent or aggressive?" asked Basta.

"No," replied Trieskey.

But the defense quickly pointed out that the victim's relationship to his employer was strictly business.

"Were you friends socially?" asked Basta

"No," replied Trieskey.

Had you been to their home?" asked Basta

"No," replied Trieskey.

Back in January of 2009, prosecutors say Marissa Devault killed her husband in their Gilbert home.
 
The motive prosecutors argue was to collect insurance money to repay a debt, they also say she was also having an affair.

But Devault claims she was a victim of domestic violence and lashed out with a hammer in self defense.

Prosecutors recalled one witness, a longtime friend of the victim who told the jury he witnessed Devault hitting her husband.

"When you say punched what do you mean by that?" asked prosecutor Michelle Arino

"She punched him," said the witness.

"Was it a kidding punch or kind of a full force punch?" asked Arino.

"No, it was an "I want this to hurt jab"," said the witness.

When prosecutors finished, the judge read the jury it's instructions.

Prosecutors are seeking the death penalty.
