Bobby Canipe has been transferred out of ICU and is recovering.
York County Police say one of their officers shot Canipe after he reached for his cane. The incident happened on Highway 321 and Mosteller Street north of the town of Clover, S.C.
The 70-year-old from Lincolnton NC was shot by Deputy Terrance Knox after being stopped for an expired tag.
When Canipe was stopped, he exited his vehicle and reached into his truck bed, rising what the deputy perceived to be a large barrel weapon.
"It does appear, at this time, that Deputy Knox’s actions were an appropriate response to what he reasonably believed to be an imminent threat to his life,” the department said in a statement. “However, a full internal investigation will be conducted.”

SLED is now investigating the case, while the deputy is on paid administrative leave.
