Gun rights group says it will sue University of Florida

ORLANDO, Fla. (WOFL FOX 35 ORLANDO) -

A gun rights advocacy group is suing the University of Florida, saying the school is not complying with the law.  

Jim Dykes, with the group Florida Carry Incorporated, says they are suing the university for what his group calls an illegal ban on guns in cars and homes on campus.

"If you are old enough to possess a firearm, you should be able to keep a firearm on campus," he said.

According to Florida Carry,  under state law, you're allowed to keep a gun in you're home and that should also include student housing, as long as the student is an adult.

Back in December, the First District Court of Appeals ruled that students should also be allowed to keep guns in their cars on campus.  While the University of Florida said they are complying with the new ruling, Dykes countered that they are not making it clear enough, adding there was simply a footnote posted on the UF website policing policies.

"We informed them that that did not satisfy the requirements of the Florida statutes, and offered to help them bring them into compliance. They refused to work with us on that and at that point we decided to bring suit against them."

UF said they ban guns in residence halls, because it's state law.

FOX 35 received a similar response from the University of Central Florida where a spokesman for the school said UCF will change it's policy to comply with the recent court ruling regarding guns in vehicles; however, no guns are allowed in student housing.

UCF student Eugene Bivins said guns should be allowed in cars, but not in dorms.

"Not student housing on campus, because that will lead to too many problems, because you could easily just go and grab your gun."

Dykes said his group plans to work with public colleges and universities around the state to make sure they are in compliance

"We will be asking them to come into compliance by the beginning of this semester and pull their regulations down as they're related to firearms," he said.

Meanwhile, a University of Florida spokesperson said they still have not been served with the lawsuit.
