    North Carolina State Attorney General Roy Cooper announced on Monday that his office has agreed to handle the case against a CMPD officer charged with shooting an unarmed man last September.
    North Carolina State Attorney General Roy Cooper announced on Monday that his office has agreed to handle the case against a CMPD officer charged with shooting an unarmed man last September.

Lawyers representing Jonathan Ferrell’s family held a press conference on Tuesday to announce the civil lawsuit being filed against the City of Charlotte, Mecklenburg County, Officer Randall Kerrick and Police Chief Rodney Monroe.

24 year-old Ferrell was fatally shot in September by officer Randall Kerrick. His family claims he was just looking for help after he crashed his car.

“I feel that I shouldn’t be here, that this should have never happened,” said Ferrell’s mother Georgia Ferrell.

The lawsuit makes three major allegations:

1. Negligence of the police chief

2. Assault and battery by the offending officer

3. Civil rights violation against all defendants for use of excessive force.

“We have some concerns with the chief's department, with the policies and procedures of the training,” said Charles Monnett, a family attorney for the Ferrell’s.

If a jury finds the defendants liable, then the jury will then decide how much the Ferrell family will receive from the lawsuit.

“One of the goals Georgia has in this case is to make sure that this doesn’t happen again,” said Chris Chestnut, another family attorney. “To make sure another family never has to go through what her family went through.”

The city chose not to comment while the criminal investigation is still pending.

Kerrick has been charged with manslaughter and the case will go to a grand jury next Tuesday.
